FastPass Driving School Terms & Conditions

1. Interpretation:

1.1 In the following terms and conditions:-

  1. “We, Us or Our” refers to FastPass Driving School,  official address:

  1. “You, your or their” refers to the customer.
  2. “Customer” refers to any person(s) entering into an agreement with ‘FastPass Driving School’ for the provision of driving tuition or Driving Instructor tuition.
  3. “Your Driving Instructor”, “your Instructor” refers to your designated FastPass Driving School provider of driving tuition, all of whom will be legally entitled to give driving tuition in accordance with UK law.
  4. “Your Driving Instructor Trainer”, “your Trainer” refers to your designated FastPass Driving School provider of Driving Instructor Training, all of whom will be legally entitled to do so in accordance with UK law.

1.2 The following states the terms which apply to the customers’ agreement in obtaining driving tuition and our agreement in the provision of that tuition.

1.3 Customers should familiarise themselves with their specific responsibilities within the following:

2. Driving Tuition:

2.1 Driving tuition can only be provided to those persons who meet the following 
           criteria:

  1. Being aged 17 years and above.
  2. Holding a valid UK provisional driving licence.   
  3. As the customer, it is your responsibility to present your Driving Instructor with the appropriate valid licence before beginning your driving tuition.     
  4. Should you fail to present your Instructor with a valid UK provisional driving licence before your tuition, we reserve the right to refuse the provision of driving tuition and/or refund any prepaid fees.
  5. Being legally entitled to drive in the UK, with no current restrictions or
  6. disqualifications still to be spent.

             2.2 You must also inform your Instructor, prior to any tuition of any issues pertaining to your provisional licence, health or circumstance which affect your ability or lawful entitlement to receive driving tuition. You will be required to meet the satisfactory eyesight requirements before any driving tuition can commence.

2.3 If your health changes throughout the course of your tuition it is your responsibility to notify your Driving Instructor in the interest of your own and your Instructor’s safety, as well as that of the general public.

2.4 You are responsible for following all your Driving Instructor’s reasonable instructions concerning all aspects affecting your health & safety.

2.5 Your on-road driving tuition will be provided in sessions of minimum 1 hour duration
and carried out on a one-to-one basis, without any third party in the car. Lessons         exceeding 1 hour can be provided in increments of minimum 0.5 hour.

3. Driving Instructor Training:

3.1 Driving Instructor Training can only be provided to those persons who meet the following criteria:

  1.  Holder of a valid UK driving licence for 3 years or more.
  2.  Being aged 21 or above.
  3. As the customer, it is your responsibility to present your Trainer with the appropriate valid driving licence before beginning your Driving Instructor Training.
  4. Should you fail to present your Driving Instructor Trainer with a valid UK driving licence before your first session, we reserve the right to refuse the provision of Instructor Training and/or refund any prepaid fees.

3.2 You must also inform your Trainer, prior to any tuition of any issues pertaining to your provisional licence, health or circumstance which affect your ability or lawful entitlement to receive Driving Instructor Training.

3.3 If your health changes throughout the course of your tuition it is your responsibility to notify your Driving Instructor Trainer.

3.4 You are responsible for following all of your Trainer’s reasonable  instructions concerning all aspects affecting your health & safety.

3.5 Your on-road Instructor Training will be provided in sessions of minimum 1 hour and carried out on a one-to-one basis, without any third party in the car.

3.6 Following your training with us (or third parties) you may be offered the opportunity to work with us. In such circumstances a separate contract will be provided outlining our commitment to you and what we will expect in return. While every effort will be made to provide you with sufficient pupils, this will be governed by market forces and therefore cannot be guaranteed.

4. Tuition Arrangements:

4.1   Your tuition is governed by the agreements made between you and your Instructor. 

  1. You and your Instructor are responsible for all arrangements pertaining to time, date, pick-up locations and duration of your driving tuition. You will remain responsible for your own time-keeping and contact with your Driving Instructor, which should be done during reasonable times of day.
  2.  If you wish to cancel for any reason, any prearranged tuition; you must provide your Instructor with a minimum of 24 hours notice. 
  3. If you fail to provide the appropriate cancellation notice, we reserve the right to charge the full fees for the tuition session cancelled.

4.2   Your Driving Instructor will endeavour to provide 24 hours notice, should it be  necessary to reschedule any driving tuition.

4.3   Any prepaid tuition may not be transferred or sold to a third party without the prior consent of your Instructor.

4.4   We reserve the right to cancel or prematurely terminate any driving tuition due to road safety, adverse weather conditions, or your Instructor’s vehicle defect, and in such instances, we reserve the right for your instructor to rearrange your tuition for a time suitable for you and your instructor. 

4.5   Should your Instructor be unable to provide your tuition for any reason, we will endeavour to provide another Instructor and arrange tuition at a time convenient to you and your alternative Instructor.

5. Tuition Fees:

5.1  Tuition fees must be paid to your Instructor before any tuition can begin. 

  1. Fees must be paid in cash. 
  2. Fees may be paid by cheque, but only by prior agreement with your Instructor.
  3. If using online card payment facility all funds must have been authorised and cleared.

5.2  We reserve the right to change our hourly driving tuition fees at anytime.

  1. We also reserve the right to change our hourly driving tuition fees for any un-prepaid sessions, which are part of a block booking consisting of a minimum of 5 sessions of 1 hour tuition.
  2. b) You will be notified by your Instructor of any tuition fee increases prior to making any further bookings that are not prepaid as a block booking.

5.3  Any tuition prepaid as part of a block booking or otherwise must be completed within  
a reasonable period, usually based on 1 lesson per week, otherwise we reserve the right to cancel the booking without refund.

5.4  Prepaid tuition offered at a discount price as part of a block booking or otherwise must  be completed in full for the discount to be valid. If the lessons are terminated early for  any reason then any credit due will be based upon lessons taken at the normal standard rate applicable at the time.

6.  Your Driving Instructor: 

                Is responsible for:-

6.1  Providing a well maintained car, that is in presentable condition, of current type, is fitted with dual control and displaying the FastPass  Driving School  name and contact details for every session of tuition.

6.2  Formulating a course of tuition that meets your specific driving and learning needs, in which each session will include an introduction, on-road tuition and debriefing.

6.3  Providing positive and comprehensive feedback throughout your driving tuition and for recording  your  development in your personal record, which will be available to you for discussion during your tuition sessions.

6.4 For monitoring and evaluating your driving ability and advising upon the appropriate time to book a driving examination.

  1. Should a re-examination be necessary, your Instructor will recommend the suitable time.
  2. If you book a test without your Instructor’s knowledge, we cannot guarantee to accommodate the date although, every effort will be made to do so.

6.5 For addressing and resolving in a professional manner, any concerns or issues
        you may have regarding your driving tuition.

7.   Examination Fees:

7.1 Driving Theory and Practical examination fees are set by the Driving Standards Agency
                      (DSA).

8.   Examination Booking Fees:

8.1 If you wish us to book your driving theory or practical examinations on your behalf, our
       non-refundable fees for doing so can be provided by your Instructor.

                          a) We reserve the right to change our booking fees at our discretion.

9.  Examination Cancellation:

9.1 Should you wish to rearrange or cancel a Driving Theory or Practical examination,  which we have booked on your behalf, we will follow the Driving Standards Agency (DSA) cancellation procedures as stated on their website at www.dsa.gov.uk.

9.2 The current Driving Standards Agency (DSA) cancellation procedure states that you can rearrange or cancel your booked Driving Theory or Practical examination providing you give at least 3 working days notice, without losing your test fee.

9.3 If you wish us to rearrange or cancel your booked Driving Theory or Practical examination on your behalf, you must provide us with a minimum of 5 working days notice.

  1. If you fail to provide us with 5 working days notice, you may be liable for some or all of the Driving Theory or Practical examination fees and/or late cancellation fees.

9.4 We do not accept any liability for fees or additional expenses incurred, in the event of
your booked Driving Theory or Practical examination being cancelled by the Driving
Standards Agency (DSA) for any reason.  All claims for fees or additional expenditure
should be addressed to Driving Standards Agency (DSA).

  1. It is your responsibility to produce both parts of your driving licence (photocard & counterpart paper) for both of your Driving Theory and Practical tests. We cannot be held liable for loss of any fees or charges if you fail to do this.

9.5 Should your booked Practical Driving examination be cancelled by the Driving Standards Agency (DSA) due to a defect or the failure of your Instructor's test vehicle, then our               responsibility shall be limited to the refund of your Practical Driving examination and booking fee or the provision of a re-arranged Practical Driving examination at a mutually convenient date and time.

  1. If the 1 hour lesson immediately preceding the test is completed in full then any refund will be at our discretion and limited to 50% of the cost.

10.  Sales Promotion:   

10.1 We reserve the right to introduce or withdraw any sales promotional special offers, which may or may not include tuition fee reduction.

11.  Data Protection: 

11.1 Any details pertaining to your person will be held securely in accordance with the Data Protection Act 1998.

  1.  We may have to pass on your personal data to a third party, in order for us to supply the service you have requested.
  2. We may supply your personal data to regulatory bodies for the purposes of monitoring or enforcing compliance to regulatory rules or procedures.
  3.  By providing your personal data, you agree to being contacted by us, by telephone, mail or any electronic means, for the purpose of informing you about our additional services or promotional offers which we believe may be of interest to you.
